Title VII of the Civil Rights Act of 1964 prohibits employment discrimination on the basis of religion. Unfortunately, religious discrimination occurs at workplaces of all kinds. Workers have rights and protections under both federal and Michigan laws. I advise clients on religious discrimination in relation to:

  • Harassment — People should never have to deal with religious slurs, religious stereotypes or hateful symbols in the workplace. When offensive behavior is frequent or severe enough to cause a hostile working environment or result in negative employment decisions, employers can be held liable for damages.
  • Dental and Chiropractic practices – In recent years, Dental and Chiropractic offices have implemented what they refer to as management techniques that incorporate and follow practices grounded in Scientology. These practices can include forcing employees to watch training videos and attendance at seminars where employees are required to acquiesce to lectures disguised as a way of increases the practices business services. 
  • Scheduling — Employers are required to reasonably accommodate requests for work scheduling based on religious need as long as there won’t be more than a minimal burden on business operations. This applies, for example, to employees who request schedule changes to observe daily prayers or religious holidays.
  • Segregation — Employers who isolate religious workers from customers or other employees due to “actual or feared customer preference” act illegally.
  • Pay and benefits — Offering different pay and benefits to an employee based on their religion is illegal.
  • Hiring and firing — Denying someone access to a job or promotion based on their religion constitutes discrimination.
